FERPA - violation or not? | Autism PDD

Share

Ok, so i took the plunge and sent out a complaint to FERPA, and i cc'd a whole bunch of other top educational people in Florida.  I did send them certified - return receipt... I'm a little nervous about this.  Does anyone know how they would investigate this? Would they inform me of anything?  Gosh, i sure hope i did the right thing....

Thanks for your support.

At the beginning of the year, I told my yougest son's teacher to feel free to disclose that my son has autism if a classmate's parent were to ask.  She told me that she could not discuss him with another parent, even though I gave my verbal permission.

I would say the assistant vice principal violated FERPA.  Maybe someone else will have a specific cite.

Since a school district is obligated under FERPA to obtain you permission to reveal any personally identifying information from your child's records and the fact that your child has autism is a part of his records (and "records" includes any written information maintained on your child by the district excluding ONLY written information kept by one person, for his or her eyes only, in his or her own personal file and NEVER shown to another human being), I believe the AVP violated FERPA.  For more info:  http://www.wrightslaw.com/info/ferpa.index.htm

Would this be considered a violation of FERPA?

The assistant vice principal informed a parent of another student's disability in a conference.

Both parents were present, but i don't think it was right for the AVP to disclose another student's disability.

Thanks...
