They can not change the IEP without your consent. Did they give you anything in writing? Parents must be informed of all changes. It sounds like they are telling you that they can not or will not stay in compliance with the current IEP. I would try to get that in writing. You can write a letter of complaint to the director of special education, and to your state board of education. The OCR does handle out of compliance IEP issues, but I think that is a long process. Look up your local office. My son has Autism and is a hitter on the bus. Per his IEP he was not supposed to have anyone sitting beside, in front of, or across from him. The school bus department was not obeying the IEP. The problem is also that he hits why passing by others. They said they they would not be able to accommodate by picking him up last and dropping him off first to have him sit in the front so no one would have to pass by him. All of a sudden when I request a special review he's on a bus by himself. There have absolutely been NO problems and the new bus drivers have been raving about his behavior being so great. So my doctor writes a letter saying if they can't sit him up front then, pick him up last, drop him off first then he needs a bus to himself. I bring the letter to the IEP and I'm told it will be done until the end of the year but not granted next year. I'm totally confused. I have to get a response out by tomorrow. I'm really trying to understand how FAPE and IDEA would work in relation to the bus. Also there are other children with special needs who have a bus to themselves. Totally confused. He's 7. There has only been a monitor and a bus driver. A lot of this is new to me. It was suggested a few days ago that I ask for a shadow on the bus. There is a lot I don't know that may help to ask for. Again much of it is still new to me. I was also told that if he hits someone on the bus he also could faces charges. That to me is very frightening. I'm just trying to do what is right. All I know is that I've heard of children getting aides on the bus.
