Preschool screening denied me FULL resultthat guarantees you the right to inspect and review your child's record. I think you need to request, in writing, your child's ENTIRE educational records. Which since the definition is pretty broad, will include a lot of documents. Here's the link: http://www.fetaweb.com/04/ferpa.summary.htm Everything I'm finding says if you're within a reasonable distance from the school (about 45 mins) you have the right to review and inspect everything, but not necessarily receive a copy of everything. You are entitled to a copy of the IEP. I would think an assessment would be part of the IEP? I don't see how you can be a full member of the IEP team without a full copy of all assessment reports. Here's an interesting article on records from a school district: www.mde.k12.ms.us/SPECIAL_EDUCATION/docs/RecordsQA.doc Apparently the laws on when they can destroy are fuzzy and may vary by state and locality. So I would do some research on the laws in your state, and find out if the school district has specific procedures on maintaining/destroying documents. I called the sp ed secretary because I had not heard back from her in well over a week and she apologized shed been super busy which is cool i didnt need this in a hurry or anything BUT then she tells me she cant FIND this paper!!!!!!! HELOOO! She was stuttering away maybe she was nervous id be upset when she told me this OR maybe she was just saying she couldnt find it so I couldnt recieve a copy and see firsthand how diff their paper and results are from mine! But maybe im just paranoid right? NOT! I said id call the sp need preschool and the lady who is in charge of the screening (was then and still is today) So i call her and she says she doesnt know if they will be able to get it for me since it was so long ago and that after spring break on the 22nd shel have her secretary look for it. Isnt this a RECORD and im pretty sure the time lapse for when they are supposed to shred records have NOT lapsed its only been 2 yrs since then. The results are quoted in his actual preschool evaluation so they had to have had a copy so now where is it?????? GRRRRRRRRRRRRRR I would probably let it go and focus on the here and now. You will be dealing with this district potentially for yrs, unless you move. That said, I would consult with an advocate on how to address the current issues that you have with the school and fight to get your son the help he needs now. I would use email for all communication with the school, so you have a paper trail. If you have a conversation with someone at the school follow it up with an email detailing your understanding of the conversation. Once the school knows you have a paper trail and an advocate, it often times changes the way the handle things. Sorry that they arent playing fair, it sucks.
Ok I am royally irked but i dont know what I can do about it except vent. My son is 6 1/2 and in 1st grade. Back when he was 3.3 yrs I took him to the local preschool screening in our school district because he had alot of troubling behaviors. I did NOT agree with the screening at all even before i saw the results because there were questionable things like when asked to copy the lady and put 2 blocks down an inch apart and another 1 on top to make a 'house' he put 1 block down and tried balancing 2 blocks on the 1 then flipping it around quickly which obviously didnt work and after a few failed attempts after repeated modeling he started to throw a fit so she stopped the activity. He also would not go near the machines to get his vision and hearing checked an dthe lady said shel just pass him because he had his well child check up recently, to name a few things. I thought for sure something will show up! I got the results and he passed in everything to my surprise! I was upset but didnt know what i could do about it at the time. They graded him in language, articulation, motor and cognitive. NOW a year or so LATER after he was about to be expelled from his private preschool I got an evaluation for him (which he passed as well! Now fast forward to today. My nephew just got a preschool screening done a week ago and just got his results in and the areas they had on his paper were in cognitive, language, articulation, motor, social and self help skills. I am sooooo PISSSSSSSSSSSSSSSED!!!!!!!!!!!!! I guarantee that the school left out my sons results in the areas of social and self help because they are nowhere on the paper I received in the mail from them teling me he passed in all areas! And there is no mention of a social delay, why? Because social was not mentioned anywhere on that paper@!! And obviously it should have been if his evaluation att 4 yrs old states he had potential delays in Social. I wonder what his self help skills results were? O yes and my newphew who has at least a moderate speech delay (most words unintelligible and jargon) PASSED in articulation of all thigns! He passed everything except for social it said POTENTIAL DELAY! Now where was my sons results of potential social delay then? I copied my nephews results incase I have to whip it out and show them. AND im pissed because i faught like hell to get my son an IEP in kindergarten they were doing alot of illegal things without giving him an IEP. This year he is at a new school (tho same district) and is getting pulled outs for reading, writing, math and OT. His teachers have been telling me hes been regressing SOCIALLY, academically and in SELF HELP! We are back to me dragging him out to the sp needs bus every morning because he is resisting going to school. He is going to be getting auditory desensitization therapy and therapy to help him eat his lunch by his OT as well as more minutes for pullouts in his new IEP. He getting testing for speech again because of difficulty understanding what people say to him and an FBA because he is spacing out all day and a ton of 1 on 1 help from his teacher. I called the sp ed secretary and requested a copy of his preschool screening results so i can compare if thier copy differs from mine. If so and i have the proof what can i do? I dont even know since it was so long ago but it seems to me they are reaping what they sowed now that hes having problems and HES reaping what they sowed and that pisses me off What would you do? I guess I should let it go but i want to make them PAAAAY!!!! I am so sick of all these 'mistakes' they are making Id like to at least bring it up so they are made aware of it tho but i dont want his CURRENTiep team to be offended so so far i have been strictly dealing with the sp ed secretary who acted as if she didnt know what test I was talking about after tellingme she cannot give that to me! Cinrtex, thanks for thelink i will check it out :)Its only been 2 years so i hope they didnt destroy them yet! It was only a screening that i am requesting which took place 5 (?) or so months BEFORE his preschool evaluation (which they deemed him uneligible for services because he missed qualifying by 1 point and advised me to take him to the park more and come back to them when he gets kicked out of his private preschool-which is what was already happening when his preschool and I referred him for that eval) We had yet another IEP meeting day before yesterday and at the end i asked about the screening with the behaviorist andshe was not understanding what i was trying to tell her, she kept thinking i was asking about his preschool eval results and not his preschool screening. When she realized it or whatever she said that even tho i didnt get the results because somene must have accidently left it out but that they refer the child if there are any potential delays. I asked her if tht was the standard procedure to refer them when they show any potential delays? She said yes so then i told her that the only reason my son got an actual full evaluation later that same year was because he was diagnosed by a doctor and i requested the eval myself and that i got no call or letter stating to bring him in for a full eval from the school. She then went on to say well its because they noted it was just a potential delay (duh its a screening!) so she started contradicting herself which i left it at that cuz i didnt want to get into a huge thing about it. I just told her i wish someone would have let me know because I could have been working on him with things which she said to concentrate on where he is now and hes doing so well.... She said shel look into what happened and getting me a copy so wel see what happens/what they say next. I am definitely going to have to add that to my list of stupid things so-called experts have said. These include such winners as: "Wait and see" "Daycare will help his social skills" (more like the opposite; when did being overwhelmed ever help anyone's social skills?) "He's not talking because he's learned to manipulate you." "He's not really sick; that's within the spectrum of normal." (the child's hair had FALLEN out) I'm sure we could make quite the list of dumb things that people with advanced degrees have said. Good luck. I do hope you get the answers you're looking for. |
