You know services were bad.....

..... when at an IEP meeting a district attorney starts talking about offering your kid compensatory services without you bringing it up.

What a mess. This year's teacher is in way way way over her head.

micki -- congrats on your chutzpah, and sorry it has been SO BAD of a year.

 

I do not have an attorney but if I had brains I should get one.

Short version: The teacher is not a bad person but I think she severly underestimates what her job requires. For some reason she decided to disregard the IEP and provide less than half the service minutes (I checked his schedule against service minutes), not do any progress monitoring (I made a Ferpa request and ask for copies of all data-there was none) and she was surprised to learn at the meeting that the tests that mainstream did showed no progress in the academic IEP areas. I really did not have to say much, though I sure had much better documentation than her. Not providing service minutes +no appropriate progress =district having to provide compensatory services.  

I was the one who requested that the the district attorney be at the IEP meeting. Before the meeting I had mailed a letter- with my specific 'concerns'- to the district attorney as well as requested that it be added to my son's due process file. I figured if nothing else the attorney will know that they are violating FAPE and will want to cover her own butt in case it would go to a hearing.

This was not really a win -my son fell through the cracks another year
