Should this be in writing, on IEP?

Hi, my son is in the 3rd grade. Brought IEP from old school to start with this year. New school has not wanted to meet and go over it, just going by old schools. However they are not going by old schools. He is only supposed to have 20minutes a day pull out for help with math. Granted his old school had him in small group for reading and math-since he does better. Anyways, his new school has him with the intervention specialist ALOT. She is basically his reading teacher with about 10 kids altogether, and his main Math teacher from what I'm gathering. He does not bring home homework, but maybe 1 time a week, if that. She says its because she likes them to do it in class so she can help them etc. Its great that he is getting extra help per say, but he is supposed to be in regular classroom most of the day. He spends over 2 hours on and off throughout the day with the interv specialist and his "small group". I know he is in there, I never signed that I agreed, I let it slide so far. But how do we go from 20 min of pullout to over 2 hours throught the day? I asked how does this school measure progress, she said as long as their grades are not getting worse, and they are basically at least staying the same or getting better. Well how does that help me? His midterm and report card are identical! Doesnt look like anything helped there, but according to that his grades stayed the same.. Am I being too picky? His old school treated him like a normal kid, but this one acts like he "needs" to be helped alot more, so in the resource room with the interv. spec..teacher..Well, if thats the case then how come we never updated his IEP to state this?? I called an "unofficial" meeting with teachers principal awhile back, and he was having impulse issues, pulling cards some etc..AT the meeting they acted like everythign was fine though, "oh we expect that with his Dx"..Well, hes a child and he needs treated the same, dont expect that..Tweek pulling the card maybe cuz it will upset him because he doesnt mean to speak out sometimes. But now I NEVER get a bad word about him..I Know he didnt quit doing these things, because as the year goes on he usually gets worse with it. BUT since I mentioned it, suddenly he's great! I just want the truth all around, but they do not tell me anything. They expect me to assume they are doing what is expected but I think they are pushing him through the easy way for them..That was alot, I know.....SOrry..lolSounds like you may need to call a formal IEP meeting (and they cannot refuse that, by the way). They cannot just ignore the old IEP and run their own game plan.

Is this a new school in a new state? If so, they are required to evaluate your child and implement a new IEP, usually within 30 days, sometimes 45. Sounds like you may need an advocate to go with you to the meeting, esp. if you are in a new state, since laws do vary. Good luck.  Same state, only 15 minutes away in new district. Just a plain pain in the as@ lol..
