school cancelations and special ed laws??Our school district does 2 hour delays any time its foggy or even the slightest bit snowy. Now mind you I live in Ohio... so this happens A LOT!! We were on a 2 hour delay today because it snowed a half an inch!! This is the 6th one in January so far! They do this to make bus travel more safe supposedly and because they don't ever have to make these days up (since they aren't full days) My problem here is every time they call a 2 hour delay it means that my son's morning special ed preschool is cancelled!! So of 12 days he was supposed to have school this month so far its been cancelled 6 times... and they NEVER have to make this up! That just doesn't seem right. Aren't they legally required to provide him services? Is there ANYTHING in any of hte laws that I can question?? I mean they just aren't being judicious with these 2 hour delays... there's no reason for a half an inch of snow (remember this is ohio... it snows ALL the time). What can I do?!?!?!? [/QUOTE]I do not know if our SpEd preschool cancels, but I think our full-day regular does not have weather closings. Our elementary school sure does -- SIX last year. Yes, they can cancel school and your child only has to have the make-ups that other, NT kids get. For example, in NYS, kids HAVE to have 180 school days. ALL kids. So if kids in a special ed school get too many days off in the winter, the school has to make up the days in the spring. Just as they have to do with NT kids. That is all the schools are required to do -- treat kids with IEPs no differently to gen ed kids when it comes to school access.The thing that got me was the school delay over 0.5" of snow.My God, if your district was here in NY you would be closed half the year, thats a tad absurd ill give ya that, wish I could help, but maby if they had my mentaility I guess your son will be at school more often. It is the same where we live. If we get snow even if it's an inch they cancel school. For the preschool because they are not governed under the same policies as the regular school don't make up days and also don't go if there is any delay. Part of it in my state is the fact that it's a partially integrated preschool so parents of nt toddlers pay for their kids to be in the program part day. Whereas if my oldest son has a day of cancelation for school they do require them to make it up. You might want to check with your school district and see what policy they have in place to govern the preschool vs. normal k-6 program. |
