I have another question about school

I posted another message about the school wanting to discuss Mason's placement.

I just received an email that they are going to start over basically and bring in an outside source to redo his FBA and BIP.  But then it states that Mason will be sent home if he physically hurts someone.

Believe me, I don't want my child hurting anyone!  But I am wondering if they haven't been doing this all year long, can they just start sending him home when he does it?  Do I let them just send him home?  Do I make it official and have him suspended?  And if they are to suspend him can they all of sudden start suspending him for behavior that has occurred in the past without suspension?  Do I need to get his school records showing that he hasn't been sent home to this point?

Maybe I'm jumping the gun, but he has hit a teacher many times throughout the school year.  Sometimes unintentional, sometime intentional.  I just want to make sure that they aren't sending Mason home for a behavior that can occur by any child at any given time, just because it is Mason.  And I also don't want Mason to learn that if he hits he gets to come home.  My son would rather be at home with no priveleges than at school, any day of the week.  How do I go about doing this to ensure Mason isn't being discriminated against just because we once again put their placement on hold?

Do I have any choices here or can they just start suspending or sending him home?

Do you have a copy of the book from "Emotions to Advocacy". If you do not
you may want to get one. Your logic is good and you are correct that your
Mason who is pretty bright will catch on that hitting someone will equal
going home. That will be his escape and will be maintained as he prefers to
be at home. So their BIP is flawed already. You really need to insist on a
BCBA who has observed Masons behaviors to help put together a BIP.   Yes, your child CAN be sent home if he hurts someone. It's called SUSPENSION. Do NOT pick him up unless they formally suspend him.  This may sound counter-intuitive, but the School District HAS to improve its interventions if your son's behaviors are officially found to be a manifestation of his disabilty. And that won't happen until the 11th day of suspension.  You WANT this on the record so that the behavioral intervention can be on the record, too.  If they are not capable of putting in place a behavior plan that works IN SCHOOL and doesn't involve sending your son home on a regular basis,  his placement is inappropriate.  Here they send  the behavior problems kids to school which is in another district. Ed bascially program!
