NEED HELP | Autism PDD

Hey all!!!!  I had written to you all that we took our son out of his school last Thursday due to saftey reasons and other issues pending an IEP meeting. 

 

We have our advocates ready and documents ready to go but the meeting isnt until the first week or so of November. Our son is getting taught at home right now with his aides.

My problem is this: we got a letter stating that we have to have him in school by Monday or the school will contact my husband's commander and child services.

What do we do??? If I let him go, what is to say the same things will not happen until we have this meeting?

Gosh that is a tough one.

Hmmm you have the right to home school your child. I depends on the state but if you can show that you have lesson plans and what your son is learning and the aides are witness to him being homeschool then you don't have anything to worry about.

The schools are required to submit him for truancy if he is not enrolled in a school program Are they aware that you are homeschooling him for now? If they are aware of it and they are doing this to be a bit nasty and make it difficult then that is really crappy.

If they are no aware, then I would talk to the Principle and show him your lesson plans. Its only one more week I would hope they would work with you on this. You have valid reasons for not sending him back, unless they are willing to provide an aide until things are settled at the IEP then they are being neglectful.

In the end...having a lawyer might back them down.

Just letting you all know that there is still no teacher as of today in that classroom. My son is still not in school but is being taught at home with his ABA ladies.

We now have the Pentagon investigating our on post school as well as my husband's  commanders are all going to be at this meeting in support of us too.

My son's Dr.'s have a note ready to go when and if he returns to this school stating that he is to be excused from missing these days due to the saftey of his trach.

We now know that Military schools have to follow federal laws which is better for the kids.

We got the letter Friday but just checked our mail today

 

I wrote about our situation under the topic of 1:1 aides.   The thing is is that My son also has a trach and they just dont seem to care so to speak. The aide doesnt carry his medical equipment around as it is instructed for her to do, they passed my son off so to speak to a sub who for one doesnt know sign language and two hadnt had any trach training!!!!!!

 

They do not want to comply to do his work in which you have to sit right next to him and prompt him to keep doing it. They say that is not what the aide does there!!!

 

Yes, this Monday!!!

I would call the school on Monday morning and just say "I'm sorry, we can't send him back to school until we have these issues resolved at the IEP meeting. Would you like to move the meeting up?"

Personally, I wouldn't let them bully me, it sounds like that is what they are doing.

I'll try to go back and find/read your other posts about your situation because I'm curious about what happened. Good luck!

Our son is getting his one on one and ABA therapy from his workers while at home. The school was notified the day we removed him pending the meeting that he would be schooled at home until then.

My husband's commanders and all are behind us 100% now and we just recieved the letters from my sons doctors about trach saftey and what the school needs to be doing.

Also, this am, his Pediatrician wrote a note for him to be excused from school for the last few days  due to trach saftey issues.

If your child is of legal school age, you MUST send him to school or he can be removed from your home for "educational neglect." You can contact the school to see about officially home schooling him, but in most states that will mean that his special education services will IMMEDIATELY be cut or significantly lowered.  If you feel your child is in danger in his school setting, get a lawyer involved.Get an attorney now!
