School Refusing to give Parents Results

My school is refusing to give a parent results of her son's ADOS, re evaluation before the IEP. It was done in August and we know it is finalized. Does anyone know if they can hold the results until the IEP? I went to wrightslaw but just saw that they must provide a copy to the parents. I know I read in their book From Emotions to Adovcacy, that they say you can not have an IEP with out first having the data to review. ???

Go to www.wrightslaw.com and search FERPA.  Family Education Right to Privacy Act.  This Act requires that School Districts give parents ANY records that are maintained by the District.  "Records" includes ANYTHING written or recorded that is not handwritten "memory-jogging" notes kept by one person and NEVER shared with another -- even for typing.  Once another person lays eyes on something, it's fair game for FERPA. Of course, this includes ANY test.  After reading up more on FERPA, go to From Emotions to Advocacy and use their sample letters to request ALL your child's records -- do this in writing and cc at least one person other than the one you are sending the request to.  They MUST give this info to you.
