i know a special needs attorney that does this work in NY. Not sure if she can work with you in NJ but its worth a try. She has a lot of experience with this and has a child with a disability. In NY, it's possible to do this and have your son live in the house until his death. The money the state saves by not having to provide a roof over his head is used for staff to help him. This gets around the zoning issues. No one can stop you from giving your child the home he grew up in. Of course, this has to all be done through a special needs trust, which you can set up thru your will. That way, you can live where you are until your death. Of course, it might be wise to put your home in the trust now so that if you ever need nursing home care, the house won't be lost. Once it's been in the trust for 5 years, it can't be touched. Go to a geriatric lawyer for all the NJ specific information or info on how to find out more.

I'm the parent of a 26 year old autistic like son--I live in New Jersey--I've fought the good fight and gotten him good services,private schooling, etc.
Now, the final struggle, I'm aging with no family and worrying what will happen when I'm gone (all those school years it was a distant fear). NEW JERSEY HAS A 10 YEAR WAITLIST FOR PLACEMENT AND I'M ON THE PRIORITY. After weathering a recent health crisis, my Case Mgr. said he would probably have gone to FOSTER CARE. Group home availability and service wise - what is the best State to live in?
P. S. Thanks to intervention, my son is a gentle sweet young man, but he still needs supervision. I have visited a few group homes that I was actually impressed with, run by private agencies (all full). There are no vacancies because even though a lot of these agencies have the land---there is no funding from NJ to staff them - hence the 10 year wait. Surely, there has to be another state better prepared than this.

I have a Irrevocable trust setup and I have offered my condo, but that is not
an option in New Jersey. I belong to parent groups and there are other options but nothing to fit my desperate single parent situation.
I know a lot of parents would do so and this would be away of "paying forward" . New Jersey is dead to me---tell me more about New York and where I would have to live, whatever.
