Yes as zayzer said, and make sure you keep copy for your self and date it. Paper trails are very important. Good Luck.
Students should be tested every year to determine PLOP and to show any progress or lack there of. We had the same issue with or son's school. Put in writing a request for testing to determine your childs PLOP and cc the superintendant, school principle, teacher and anyone else who may be revelant in your case. tell them if you don't here from them in writing you will get the testing on your own and ask for reimbersment through a hearing.
Tell them you don't feel the IEP is a valid one because the PLOP is outdated. Make sure you ask for objective testing or they could just go on teacher observation. I wouldn't sign an IEP with an outdated PLOP.
They can't just deny your request without giving you prior written notice but schools often do. When I asked for prior written notice when my request was denied we got testing instead.

I have a quick clariying question on testing. My son is 4 years old at a public special needs preschool. It has been more than a year since his last set of evaluations. His PLOPs are horrendously inaccurate and outdated. We asked the school to conduct new tests (their choice of tests) to determine new baselines. They told us they weren't going to do that (didn't give us a reason yet).
Aren't they required to conduct tests if we request them? I'm assuming at the very least if they say no, they'll have to give us prior written notice. Is that correct?
Please everyone learn from my mistakes and insist on accurate PLOP each and every year. I am kicking myself in the rear for taking this so lightly in years past and will be insisting from now on. I never made an issue and just went with teacher observations for PLOP. Because of my negligence, what I suspected was true and nothing has been addressed about it up to this point.
I posted on another thread that we had some independent testing done and my 6th grade A B student who according to teacher reports every year "is doing so well acedemically" is comprehending at a 3rd grade level.
I have learned now, but wish I would have learned when he was much younger.
I know in our district we are required by law to conduct a re-evaluation every 3 years to determine need for continues support. Also, if the parents request it, child is declining in skills, or if the therapist and or ESE teacher needs to update goals/objectives we have to....again, we do not have a choice, it's the law.
I know every state and every county within that state operates diffirently........look at your procedural safeguards for the accurate information or call your local ditrict ESE office and they can tell you.
