...............and the school's violation of his IEP. Okay Michelle gave me a link for advocates in Mineapolis. Thank you again Michelle!!!!!!!!! So I called PACER again, no phone call yet. And I called them twice. His social worker is also not taking good notes either. He never did get the social stories over to the overnight respite provider to help Jeffrey function. So I called the Minnesota Disability Law Center. They referred me to the Mental Health Ombudsman. So I talked to her. So far we have at least three violations of the IEP, along with a total lack of communication. So here are the violations: Lack of communication between me and the school. Jeffrey asked to have an IEP meeting. I communicated this to the school social worker, who is the IEP team leader. She said she would schedule the meeting after spring break. Didn't happen. He asked for his social stories and weighted blanket back. Didn't happen. No transitional planning for summer school occurred. And according to the IEP, "To help Jeffrey cope with stresses around bus rides to school, he will have access to a social story as well as other visual aides, such as a map where he can draw the route. This will be developed by the autism teacher." This was never done during the school year or for summer school. No transitional planning for summer school was done. The behavioral modification plan was violated. No schedule for him to look at was provided. In his functional behaviour plan it states "Jeffrey is sensitive to certain kinds of interaction and redirection that he interprets as teasing." Remember he has the kid in his special ed class that constantly teases him. In my opinion this would interfer with his learning process. And the list goes on and on. No printed schedule was provided. No coping social stories was provided. And according to the Minneapolis public school's own website: All students are eligible for referral to the school psychologist. Psychological services include: helping families understand how children learn; consultation regarding academic skills; emotional and behavioral needs, and mental health needs; intervention development, monitoring and evaluation; providing social skills instruction; participation in special education evaluations. Services are usually provided following staff, parent or school team referral. All students are eligible for referral to the social worker. Social work services include: case management services; indirect and direct social work services for students with disabilities; crisis intervention for students and families; consultation with staff regarding social, emotional, and behavioral needs of students; monitoring of procedural safeguards; facilitating parental involvement in educational planning; monitoring students with chronic attendance problems not due to chronic health problems, and students at risk of dropping out; implementing and monitoring behavior management plans; mobilizing and coordinating community and school resources; provision of activities within the school system that benefit students with disabilities and promote their full integration into the mainstream environment. http://www.mpls.k12.mn.us/Special_Education_Services.html Nothing was being monitored at all. So right now it looks like we call an IEP meeting ASAP. Put the district on notice that we will be monitoring his IEP more closely to determine if they are following it. And to demand some explanations. Tammy I wish you and your family all the best of luck. I hope that it gets worked out! I know that when things are not done as planned in the IEP, it can have very serious consequences for our children. Okay update time again. Jeffrey has not had a bus aide for over a week. The aide was in the hospital and didn't come back until Tuesday. So they replaced her with a more reliable bus aide. Only problem is the aide doesn't start until Monday. So the social worker said she would pick him up and drop him off, problem solved right? Wrong!!!!!!!!! She didn't take the highway on the way home so we have a miniature meltdown going on. Miniature for Jeffrey. No aggression yet. But if this is the way it will be tomorrow, I will either not send him or just plan on taking him somewhere tomorrow. Suggestions? I wonder if everyone on this board had kept a list of all the times we were promised services, or told 'I will get back to you", what the number of lies would total? Now, I dont think everyone intends to not tell us the truth, but it just happens so often. I cant begine to tell you the unanswered emails and the unreturned phone calls for me and my DS is only 4 and has only been dx for about 1 1/2 years.((HUGS)) if ya want em. I am so sad for your family, because I know how a little change in plans for my son can cause big problems.How's he doing now? Calmed at all? You have it written that if there's no aide, you don't have to send him right? I'd opt for that unless you can talk your social worker into taking the "right" route! Which will be a problem getting him to go to sleep tonight. He did regroup himself real nicely. Which is a major improvement. The IEP will be this month sometime. Still working on the schedule. He kept on saying he didn't want to go to school tomorrow, that he wanted his bus driver to pick him up. Oh yeah and he doesn't like the social worker now, lol. Well today was Jeffrey's IEP Meeting Day. Woohoo!!! Not!!!!!!!! First off, Gabe had to have one of his bad days. Wanted to wear the same clothes he had on yesterday. Doesn't understand you just can't do that. Then begrudgingly he changed his clothes. Oh yeah but first he had to throw a fit and throw the alarm clock on the floor. See he was trying to stay home so he too could come with me to Jeffrey's school meeting. As Gabe was getting on the bus he told me "I don't like you!!!" Fine, not suppose to like the parent all the time. At least he got on the bus. And no call from the school today on Gabe. I rode the school bus with Jeffrey to school to get to the IEP Meeting. Well first off the bus driver said the bus aide quit. Okay so here we go again. Jeffrey says "no bus aid? Man I can't ride the bus then." I also noticed he is not the last one picked up. Now I did notice on his ride to school you do pass all of his favorite landmarks. So that was nice, lol. So I get to his school and he can be so shy when greeting strangers. Quite cute actually. He bows his head and is grinning from ear to ear and says hi. Before the meeting officially started we talked about the transportation issue again. The social worker said she emailed someone in transportation and they might switch him to a different bus. First off we have to start doing the transition paperwork since he is almost, gasp, 14. Wow they grow up so fast. That has to be done by his birthday. He is mainstreamed in reading, social studies, and science. They started mainstreaming him for science this year. He is scoring in the middle for reading compared to nt kids. Which is pretty good for his class. His reading teacher said he is the most polite student in his class and that includes nt kids. So great points for politeness, which Jeffrey is really great at. They are starting him on a computer reading program, which he seems to like. And his reading has improved. In the winter they will introduce him to a typing program, which he shows an interest in doing at home. They are testing him on reading with the NALT test. He seems to have problems with reading comprehension. I suggested that we see if it is more of a short term memory thing and have him read something today and ask him questions on it tomorrow. His math is too inconsistent at this point, along with the telling time. He still has issues with the counting of money. He can count it out if using dimes but once you add quarters it confuses him. They do a coffee cart at school where they go around asking people if they want coffee, hot chocolate or tea. And they give the change out. Which he loves doing. His speech is increased on one to one to 60 minutes a week, which is max allowed by state law. Had to correct the speech therapist on one thing she said. She suggested that when it comes to his landmarks just tell him he won't see them today. I wish!!! I told her that I disagreed with her, that that is part of the ocd type behaviours. I did suggest that very clear language be put in the IEP in regards to the ocd type behaviours. Like when you see him going from subject to subject, that is the trigger that the ocd type behaviour is increasing. He is getting agitated. On the weighted blanket his teacher has said he has never asked for it even when she offered it. Summer school was briefly discussed. His advocate from ARC was there and she asked if summer school was held at his current school. And she was basically told the district holds it where the district sees fit to save money. But in Jeffrey's case we could have him have his summer school sessions at a different place like the park or the library. Now if Jeffrey has any say on it, you know where he will have it at. The University of Minnesota. Next fall is his time for his three year review but we will do it in the spring since we don't know if he will have some of the same teachers next fall or not. And they did point out there is always some form of regression after coming back from summer break. So far it is okay, just have to see what the proposed IEP looks like. Tammy So is transportation still up in the air then? Has he been going to school yet this year? Funny how his ears perk up when he hears there's no aide!!!! He sounds really sweet Tammy..... Anyway...I'm glad it's 'over' now for you...what a long wait. Hope that they cover everything thoroughly and that he has a great year....Congrats on surviving it! :) Lol, I was dreading the meeting. Why do I get the sneaking suspicion that if the advocate wouldn't had been there, it wouldn't had been as good as it was? I just assume he will ride the bus with the regular driver in the morning until they switch it. But dang, your guess is as good as mine. Sometimes I think molasses thickens faster than transportation gets their butt in gear. I do know that Gabe's thing with his IEP won't go as smoothly. But then again I will have the same advocate at the meeting so anything is possible. Now if he could had had summer school at an "off site location", why wasn't I told this before now? That is an interesting question. Tammy Tammy, Glad to hear that things went smoothly at the IEP. Hey I was reading recently in a book and I thought of Jeffery and his landmarks. Here is what the book said. REWARD YOUR CHILDREN FOR BREAKING A PATTERN Some fixations are simply patterns that the children get in the habit of completing, so they become upset if they feel the pattern is not completed. For example, Some children will be bothered all day long if MOM or Dad doesn't drive a specific route to school. If that's the case with your child, one thing you can do is reward him for breaking the pattern early in the sequence. You essentially want to stop this kind of fixation before it really gets started, so distract, then reward: distract your child before the ritual has gotten to the point where it looks unnatural and then immediately reward him. Remember, the further on into the chain your child gets, the harder it is to distract him and the more inappropriate it looks, so try to break the pattern early on. If you can consistently break the pattern before it gets fully under way, you'll nip the habit in the bud. One child who was upset if his mom drove a different route to school was distracted AND rewarded by an audiotape. WHen his mom gave him headphones and his favorite tape, he didn't mind if she drove another route. ____________________________________________________________ __________ When I read this I thought about you and Jeffery. Don't know if it helps or not. The book is called Overcoming Autism by Lynn Kern Koegel, Ph.D. The author does not believe in "CURE" for autism but a lot of managment techniques etc. It's all very interesting. There is advice for all different kinds of behavior etc dealing with autism. Just thought I would share. Might even have to have a "special transportation meeting". Don't know yet. I have learned to be very specific in the IEP language. So my advocate is working on that one. I will have to see what assessment the psychologist comes up with. He has another meeting with her on Monday, halloween, lol. Lets see the last time I was at that hospital on Halloween, it ended up snowing 36 inches. I was 8 months pregnant with Jeffrey at the time!!! Sure in the heck hope it is not deja vue all over again. Considering the landlord still has not turned on the heat, but that is a whole other different forum and different thread. And yes he is in violation of Minneapolis housing ordinance 244.460, lol. Tammy You know....this just struck me...Transitional.....is he headed for High School next year?!?!?! I think the eighth grade is still in his current school. But he is also 14 at the end of November. And I guess by law once he is 14 they have to have the transitional paperwork in place. Remember he repeated kindergarten because he needed the repetition. Tammy Ah that's right! Drafting and Architecture 101!!! How fun! (do you have SimCity for the computer? Has he ever tried it? He could prob. re-create Minneapolis!!)Well that sounds good actually, it's great to hear that they'll work on real-world needs at some point. Of course, Riley insists he'll never be married ("ewww!") and plans to live with us forever! All that just seems so far away, but time does pass too quick... Yeah I do but he wants SimCity 4, the deluxe version. Lol the deluxe version has rush hour in it!!!! I wonder if he will be as impatient with the game as he is when we are in the real rush hour!!! I told him he might get it for christmas. Yeah that holiday will be here before you know it!!! Tammy Well I finally got through his IEP and his transitional IEP. Not happy with it. Some things are too vaque. Like ocd type behaviours is not mentioned once in the IEP or the transitional one. Just that he likes seeing his landmarks before school and/or afterwards. It does say he saw the twin towers go down on tv but doesn't say he saw it at school!!! I want that in there. The transportation is so buried you have to go through to find it. That needs to stand out more. The summer school placement is too vaque. I want his IEP to look like something anyone with the district office reading it could understand his issues. Is that being too unreasonable? I don't think it is. Tammy tabitha make sure you ask for compensatory services. whatever he did not receive and how he has regressed should be marked down and the state can make the district give your son compensatory services which need to be worked out in meeting how he will receive them. can have it after school or added to school day depending on what he needs.They never mentioned that. Neither did the advocate. Like give me an example of a compensatory service. I know the only option they gave me for summer school was to have them do in home services, which won't work if Gabe is at home. Also they said he could go to St. David's Day Camp for social interaction. ONly problem is one, its not free, and two I have to pay for the transportation and any off site activities they do. Plus the social interaction he gets at this day camp is with other special needs kids. Not any interaction with normal peers. Another thing I saw in the IEP that I forgot to mention was one sentence that I think needs more clarification. And I quote: "He is not hearing voices or music in his head this year like he did last year." Now I know he complained about this one kid that played this african music and it would repeat in his head. Voices, unless it was a cartoon replaying in his head, I didn't know about it. Tammy UPDATE!! I did get all of the changes I wanted in his IEP!!! It even specifically mentions him seeing 9/11. And the word sensory breaks was taken out and ocd type behaviours was put in there. Now I did check on compensatory services and that would not apply. Since most of these kids has some form of regression over the summer, they would not give you compensory education. It would have to be severe acadamic regression and he didn't have that. Tammy Tammy I am SO happy you got all the changes you were after! Congratulations!. Now lets hope they "stick to the plan". Yeah lets hope!!! Now to move on to Gabe's..............wait I have to move, forgot there for a sec. Lol, no not really but you know how it goes. Tammy Tammy -- "Compensatory services" are not to compensate for regression over the summer. What compensatory services means is that any services your son had on his IEP and that they failed to provide (for example, if he had 5 days a week of speech and the District could only provide 4 for a month, he's have 4 sessions of compensatory speech coming to him). So check to see if your son missed any services over the past year and demand that they make up for that. Also, when it comes to regression, there's regression and then there's REGRESSION. Over the summer, some kids regress to the point that it takes them an inordinate amount of time to get back up to speed in the fall. These are the kids who can get summer services to prevent regression. Around here, "substanital regression" is taken to mean that the child will not be up to his June level by mid-October of the following year. The regression can be academic, behavioral or social. If the child takes that long to get back up to speed, he gets some kind of support during the summer. I haven't read this whole thing, but I did want to post about compensatory services and regression. Tzoya... Possibly you had a error in there so I wanted to ask because I didnt quite follow... If it was 5 a week and they only did 4 in a month would it be 4 each week they owed him over the course of a month equaling around 16 they owed him? I thought it may have been a typo when you said a WEEK then went to a MONTH but I want to be sure I understand. Thanks! Its a mute point really. In the summer they don't concentrate on educational but more on having fun I guess. The teachers also want that paycheck but don't want to put the effort into teaching the kids. Plus it used to be any kid that wanted to go to summer school could. And this occurred during the summer, not during the school year for the most part. And during the summer the school decided to ignore the ocd type behaviours instead of dealing with them. And since the IEP now states that he has ocd type behaviours, they are gonna have to deal with it. Tammy Sorry -- What I meant is that if your child has 5 sessions a week on his IEP and they could only provide 4 sessions a week for a month, then you'd get 4 extra sessions scheduled somewhere into his life. Even if that meant during the summer. So if services were supposed to be given, at any time, and they were not, you can ask the District to compensate. However, you probably can't ask them to compensate a year later. It must be requested fairly soon, I would imagine. When our son was in elementary school, the school did not give kids speech during weeks when the other kids got standardized testing. I think they used the speech therapists as monitors in the test rooms. Anyway, I was not aware of this at first. When I found out (after the fact), I immediately asked for compensatory services and also had it written into his IEP that his services had to continue DURING the testing weeks in the future. All of that happened. Sorry for the confusion about what I was saying. Hope it's clearer now. Unfortunately there are alot of things in the summer that you don't get, that you do get during the school year. They basically concentrate on the core subjects they are behind in, academically. Not that many people work during the summer either. Tammy Well that lasted long. Shouldn't be surprised, really. Friday his communication notebook was not wrote in. Today it was not wrote in. But he came home and said a girl at school almost hit him today. I asked him if he told his teacher and he said no. I asked him if he told anyone and he said he told the bus aide. I asked him what the bus aide did and he said nothing. I later asked hm again and he said he did tell his teacher. But the teacher didn't do anything and he doesn't know what the teacher told him. Of course his aggressive behaviour has increased tonight. To the point where he raised his hand to hit me. I did ask the advocate about the IEP, in that it is not specifically wrote in there that they are to write in it daily. And the advocate said that is understood. But is it really? Tammy (((((((TAB))))))) It sounds like you really have your hands full! What is up with these schools?!! I bet if it were Jeffery that hit someone, they would make sure something would've been done to rectify the situation. Does the school there even have any knowledge about autism? Poor Jeffery! I can understand his stress. I sure hope he doesn't ever hit you!Wow...that's messed up...poor kid. Please keep us updated on how this goes, I can't believe how blatantly they denied this help...amazing. I'm sickened that he even asked for these things and it was ignored...you finally get them to a point where they recognize their own difficulties, and the tools you've taught them to use are suddenly unavailable....that's just wrong beyond belief. I must admit I was thinking that the item would probably have some figure on it where I couldn't afford it. But I am quite impress!!! That is the first site I have come across where the prices are reasonable. And the journal book could work with any kid that has an IEP. I was also looking at the used school books link and again, very reasonable price. So thank you again for the link. Also I was told that I might want to get a lawyer and see if I should have a lawyer come in now or wait until later. Tammy I wanted to find a lawyer for some support issues with the xdh and was referred to several by the local austism society thing (sorry, I'm not good at the resource names...til I need em). Anyway, some of the people were jerks but I finally hooked up with a family law guy with an Asperger's son. He gave me an initial consult free and was very helpful. It was a lot of work, but now I know where to go! Good luck. I follow Jeffrey's progress on here and hope that you kick a** in the IEP. pat The director of special ed placement wanted to have a meeting on Friday with his current school. I am not ready for a meeting yet. Even though his neuro could had made it to the meeting, I feel like they are trying to rush a meeting on me. We will have one just not before school starts. We will be filing a complaint with the Department of Education stating that the current IEP is too vaque, which is an illegal IEP in this state, and that the IEP he had in place two years ago should be used until a new IEP is made, and when that one is made it will be along the guidelines of the one he had from two years ago. His current IEP is 10 pages. The one from two years ago was 24 pages. Someone is not doing their paperwork. GOOD FOR YOU! What happens when a complaint is filed? (other than hopefully they'll think twice before messing with his sevices next time) Good luck to you...sounds like they really screwed up. Are you holding him out till after the meeting? Thanks for the update Tammy...I've been wondering how things are going there with you...glad to see things are coming along, although I know it's a slow gruelling process. ~Lesley They have 60 days after the DOE receives the complaint, and that is even during the summer. We can also file another complaint while the first one is being looked in to. Also my advocate knows this lawyer, that I guess is pretty good, and she is gonna have her look at the complaint before we send it in. Maybe even have her sign the complaint, don't know yet. Oh yeah the special ed placement person said she would have the IEP case manager call me. Lol, no phone call. The only one I got today was from the health office on the conscioutious objector form for the shots. Yikes...60 days? That's like forever in our world!!! That's sep. from the IEP though right, you're still going through with that in the meantime too? Great news about the lawyer too, even if you don't use her now in an official capacity, great to have someone go over the wording, and then if you need help in the future, at least your advocate can hook you up. It is soooooooo difficult to have to fight over every little thing.There still hasn't been an IEP meeting yet. Yeah I know I am stalling a bit on that but I am waiting for a report from the psychologist on Jeffrey. I figured if we had one before that we would then have to have another one after the report came back. So far the school and his teacher are writing in his communication notebook. But I am also working with ARC too. They are very helpful so far, alot more than the Autism Chapter here. That place has never to this day called me back. The biggest issue lately was transportation. He had a really good driver then a sub came in and all of the work I had done with Jeffrey went out the window. It seems the sub thought if you told Jeffrey you would go thru the local streets he would accept that and everything would be okay. Wrong!!!!!!!!! And the sub wasn't waiting on the bus aide either. So two days last week he rode without the bus aide. The second day he came home and was getting towards meltdown mode. I was seeing behaviours again that I had seen during the summer. The bus driver was not going the way he was suppose to go, even tho the bus aide had told him to take the highway. So on Wednesday when the bus showed up and no bus aide I told the driver no aide, he don't ride. The aide shows up later to take Jeffrey to school. She told me the sub driver was not waiting on her and basically the sub was not listening to what people were telling him on Jeffrey. I was all set to have an emergency meeting with transportation but surprise, surprise, the school was actually on my side with this issue. His regular driver is back now and she told me she always takes the same route and Jeffrey is not a problem for her. So that was resolved for now. Now his special ed teacher did tell me if summer school is not held at his current school that they will do ESY in the home. I don't like this because less structure, no social interaction with his peers. There has to be an alternative to that somewhere. Lol, school year just started and already thinking about summer school? Not gonna let the district wait until the last second to make a decision again. Oh yeah and I did ask to update his behaviour modification plan. His teacher asked if I thought he needed it and it must had been the way I said yes. She didn't challenge me on it. But we can't update it until fall of next year. Tammy Hi there!! It's nice to 'see' you!!!! That is a good question. I don't know if they can modify the behaviour plans or not. Even though his current one is very detailed. I know at the beginning of the school year he was sleepy during school but that was more of a medication adjustment. His zoloft had been upped to 100 mg's and now it is back to 50 mg's, with the hopes of discontinuing that drug soon. I feel like I have my own pharmacy. Now it seems like Jeffrey's situation is halfway straightened out and guess what? Starting to have some minor problems with Gabe and his school. For example, communication notebook. I talked to his teacher before school about that and she agreed, or I thought she did. She said "okay", isn't that agreeing with doing it? Oh yeah , they have this warped idea that when he is having a "bad day", all they have to do is call me, and he will straighten up. Not Gabe. Also we had his IEP meeting at the end of the school year and I got the "proposed IEP" like the next to last day of school. I didn't sign it but I never got any letter stating it was enacted either. So does he have a current, valid IEP or what? I do recall his own behaviour modification plan was never discussed at the last meeting. So I just might request that they do another one. They can balk at that idea all they want but so far he has had two incidents at school this month. Tammy I only skimmed through this, but it sounds like a big part of IDEA is that they do not create behavior plans JUST to control behavior, but that they are required to help teach skills...also seems like if one is needed, assessment including, it should be done WHEN it's needed. (sorry I'm kind of in a 'world' after our neuro appt today...I'm going to go have a drink (a big fat margarita...) and check back in tomorrow after our final psych appt....WISHING YOU LUCK!!!) Also, find out from other parents if they feel like their children are getting a Free and Appropriate Education. IF they feel the same way as you do, tell them to write complaints, too. Once the state gets so many complaints, they will come to investigate what is going on in that school district. That is what is happening here. Having a support group with disgruntled parents help! We are ALL going to the next board meeting to TRY and resolve these issues. I sure hope they not only listen, but do something to correct these situations! It sounds to me like you have gone through the other channels so now it is time to take it a step further! Oh, by the way, if you did NOT sign the IEP, it is not valid. hope it helps just a mom my son has a BIP in his IEP yes go to reedmartin.comThere are no support groups here, that are sponsored by the school district, after the child is seven years old. Now ARC does have support groups but you have to be a member to be able to attend. Which I probably will end up doing. And I will probably have ARC look at Gabe's behaviour assessment and see if there is anything to be done with it. As far as the IEP goes, in this state by law if you wait more than fourteen days and do not sign the IEP, it does go into effect. IDEA lets the states have too much leadway in certain areas. Tammy My support group is not sponsored by the school district, either. These are parents who are fed up with being pushed around and around to where their children do not get the help they need through the school. That is why I am going to continue to go to my support group meetings. Apparently we hafta fight the school district every year just to be sure our children are getting an appropriate education. This support group is paving the way for other parents who come after us and for those of us who are still rather new to all these laws, IEP's, mediation, Due Process Hearings, etc...I sure hope you find a good advocate to to with you to your IEP's. And study, study, study, to know your child's rights and be able to enforce them with the law to back you up. If support groups can't do it, nobody can! Jeffrey has not had a bus aide this whole week. Which was fine as long as the regular bus driver was driving the bus. She knew the exact route to take, which kept him happy. This morning the substitute driver showed up. He has no clue whatsoever about autism or even ocd type behaviours. Of course no bus aide either. And Jeffrey told me that his bus aide quit. As per his behaviour modification plan, if there is no bus aide I don't have to send him to school, and it won't be counted against him. Tammy Is the "bus aide" in his IEP? IF so, then for sure keep him home! AJ doesn't have a bus aide in the morning. However, he is one of the "easiest" children to keep in their seats AND they have seat buckles, now. When he comes home from school, there is a "bus aide" Apparently, one of these parents, said they "needed" a "bus aide" Hmmm it makes me wonder IF I am gonna hafta fight THAT battle, too, in due time. These battles are soooooo exhausting! I guess that is where the old adage stems from "...You have to "pick" your battles..."
Yes it is in his IEP and in his behaviour modification plan. The school also told me that even tho the bus aide is very good with Jeffrey, she tends to miss alot of school from being sick. Oh yeah and of course no school today. And I found out about that hummmmmm.....................yesterday afternoon!!!!! So we have established a plan b here. If a substitute driver and no bus aide, to call the autism social worker from the school and she will come and get him. Now she told me she would talk to the bus aide on Monday and basically tell her if she is going to miss alot of days then she will put a different aide on that bus. Tammy |
