Can you report it to the state. In Missouri there a background check required for anyone whe's going to work with kids-. If you could report the incident to the background check then any future enployers would be aware of what happened. 

Why is PARC still employing her? You could try contacting your local paper and radio station and great a big stink to put pressure on PARC to dismiss the teacher.

Astrid...what a disturbing story.  I'm sorry Mekola had to endure that, truly.

I would think (I don't know Florida law) that you absolutely could press charges (civil? criminal?), however, winning the case is always another matter.  Do you have a paper trail of the accusations? (sounds like there is at least a police report)  Along with her admission?  Do you (please?) have pictures of the bruises?  Did you pull him out as soon as you realized what was going on?  Did they deny any other deny previous questions from you?  Do you know any of the other parents there now?  You could at least give them a heads-up...or maybe get some collaboration?

I know in my county they do have a legal aid department, and usually can find a pro bono lawyer (unless money is not an issue) but again, unless you have substantial evidence, some lawyers may not even want to take the case.  I would at the very least ask if you could be charged with slander if you were to say, write letters to your local tv and newspapers. 

Unfortunately the charges against this woman were dismissed because Mekola was in 'custodial care' and he did not have any 'obvious injuries.'

WOW!  What does that mean?????...what an insult to both you and your son...can't believe the school would allow someone like that to continue to work with these kids...unbelievable.

I absolutely hope that you do take further action, as you said, to prevent her from doing this to another child.  Please keep us updated, like I said, this was absolutely disturbing to read today.

Just a silly question, if the school got any federal funding, could they lose it?  I mean kicking a kid back that has autism to teach them not to kick?  To me, I don't know, that sounds so childish like.  Maybe check with your attorney generals office and see what they suggest to do.

Hello all!

I just registered here and would like to get some advice on an abuse situation of my son, Mekola, 5, autistic, at his last day care.

My son, Mekola, was attending a day care for special need children from June-July 2005. While he was there his legs started being covered in bruises. At first we thought he might be fighting with some of the other special need children. At the end of July however, one of the other kids in his group reported to a teacher that another teacher had kicked my son. The director of the pre-school division at PARC (Pinellas County Association for Retarded Children) reported this incident to the police, who investigated the case.
The teacher admitted to kicking our son as an 'educational tool' since he was not responding to verbal warnings and directions. She told him she was going to kick him back next time he kicked her, and so she did.
We are confident that this was not an isolated incident since my son's legs were black and blue the entire time he spent at PARC. Moreover, given the teacher's attitude it is quite obvious that she believed her actions to be justified.
Unfortunately the charges against this woman were dismissed because Mekola was in 'custodial care' and he did not have any 'obvious injuries.'
As far as we know this teacher is still working at PARC and most likely still applying her most inappropriate 'teaching methods' to other unfortunate children with special needs.
 
We desperately want to make sure that this woman never gets the chance again to hurt another child. Can we take legal action in this matter, or can you refer me to someone who could answer this question, please???

Maybe you could contact you state board of education........I am not sure......but it would be worth a shot........I am anot talking the local school board but the state school board.......Please ask for a copy of the  police report concerning the abuse on  your son...........they should be able to yank her liscense for teaching...........Good luck........you might also seek a lawsuit against that school for not protecting your son from harm and abuse.........again ........Good luck...........
