Have you taken pictures of the marks? I'm sorry it sounds like no one is
willing to help you out. Sounds like you need to get a lawyer to help you
out with this.
I suppose it is a good thing this teacher is retiring (& in effect, perhpas
admitting guilt?), but I imagine you have grave concerns about the next
teachers, the aides, the school's training, etc. Someone defenitely needs
to get to the bottom of this, & make immediate changes in how they
handle discipline, etc. Does your dd have a BIP? What types of behaviors
was the school concerned about? I would request (verbal & in writing) to
meet with your IEP team, in a formal setting, and go over all of your
concerns. You may want to bring an advocate in, or someone else to
ensure you stay calm (I know, even for such an infuriating situation). I
would tell them your concerns & observations, and review their discipline
policy. Write up a BIP if necessary.
Did your daughter begin with the school & daycare at same time? Just
wondering if she ever had marks prior to starting school. I would look
into both locations, you never know if a new staff person etc. was at the
daycare. Does your dd ever hurt herself? I'm not saying that's what is
going on here, but something to rule out...my nephew (PDD) will scratch
up and down his arms (bleeding) when he is having a stressful day. My
dd used to bang her head until she had marks on her forehead. So, just
something to make sure is not going on...and so also, if some of the
marks are from this, to ensure the teachers are handling the matter
appropriately.
Ultimately, if you feel your child is being abused in anyway, I would not
send her back. I would contact a lawyer, see what your options are, and
go from there. Protecting your daughter & advocating for her are key.

Seriously, I would flip out. You should have seen me when this little boy kept biting my daughter at day care - it broke the skin, OMG one of them was so bad I had to miss work to take her to the doctor. They never did anything about it because the mom of the kid doing the biting worked at the daycare. I had a meeting with the director & I felt the same way, was not taken seriously. She does not have Autism, she was only about a year old at the time. I basically gave them an ultimatum, it was the biting kid or my daughter. They finally kicked the biting toddler out of the daycare, the mom was PISSED at me & the staff were kind of weird towards me after that so I ended up pulling her out anyway after a few more months. She was only there part time to begin with. And that was just biting - I dont know how to handle that if I were you, I think the other members will have some good ideas. Maybe you should get an attorney.Get an attorney, pronto! No forum can really help with this.OMG, that's so terrible. I don't have advice as I am not from US, but I just wanted to say get a lawyer and nail the bastard who did this to your angel.

Hello Everyone and thanks for the replies! I have tried to get a lawyer but all of them have said, "We don't take cases against Schools that's state!" I have got a guy trying to help, for free, and it shows! I thought he was serious, but when I finally read what he put together from the facts I gave him......it was like he wasn't even listening to ME. The incidents were all out of order and he even lied about random topics, which I don't even see the point. I went to Sheila Jackson-Lee via email, per referral from a friend because she is on the "state level", says my pal.....she would know best. I dunno about that, but I am willing to try just about anything now to get justice. ---------As far as the timeframe diff. from daycare to school, would be about 1 1/2 mths to 2 mths prior to school starting. Actually at that time, I do not recall any new faces at daycare. As far as the mark on her leg, I am about 99% sure it was the school because the daycare mgmt called right around the time she gets off the bus AND the documentation lists that there was a mark on left leg along diaper line on that day. It looked like a bite or bee sting at first. It was light red and swollen....but the area was larger than I'd like to see on my then 3 year old......it browned over once it dried up some. I dunno, but I would like to think someone can regulate both schools and daycare.I had something happen with Payne...I contacted an attorney, the police - filed report, the principal, the ESE director for the school board, etc....all the way up to the school superintendent. The lady was let go...I picked the school I wanted.

My name is Tricia and my Daughter is Kaylen. She is 4 yrs old and autistic. Kaylen was enrolled in school in the Aldine District in Houston, Tx. I need to know who I can turn to after being disappointed by CPS, The Local Police, The Aldine Police, MHMRA, and out of a "desperate" attempt, no return call from the NEWS stations. Kaylen was having trouble in school within the first week. They switched her teacher after I complained about finger nail marks around her arms and knees. Then after switching classes it seems that the school was constantly calling me about Kaylen, which I understand to a certain level......but there was an incident with her "wiggling down the stairs" of the bus while there was more than 3 adults there. Another that are visible in her school pictures of welts on her face that resemble a slap or scratch marks. The final incident included a trip to the emergency room because at first I could not tell what was wrong and come to find out it was a carpet burn and I have pictures. There is also a document that the school provided about a "mark" around the diaper area on her left leg from the same day that this appeared. They are claiming that it was not the same BUT it didn't appear as it did in the pictures until after the "abrasion" started drying up. I am upset that no one has helped me. The school is blaming the day care for the marks on her, but I have documents that match up by THEM the SCHOOL and pictures.....as well as the noted difficulties they had with her. The teacher that she had during the majority of her schooling has decided to get out of special ed because of the stress I have caused her by my "accusations". The Special Ed coordinator was mean to me and basically gave me a how dare you speech impling that they are professionals etc etc. You know, I would think any person with a heart would say, " Mrs. White, We will get to the bottom of this! " . I am frustrated because it isn't Kaylens fault that someone did this to her and she is the one paying for it, both physically with her scars and she is loosing valuable time education-wise. Who else can help us?
