when we moved, our old IEP expired. Under those circumstances, do they need to have a meeting if they are just going to implement the old services?
I think they are questioning whether we are entitled to services because we moved from NYC District into a suburban district.
We actually want MORE services so thats why I want to speed the process up. My DD really needs OT and she doesnt currently receive it under the old IEP.
If a move is within the state, the new school doesn't even have to have a new IEP if it does not want any changes made...it just implements the old school's IEP until the date of the Annual Review. Of course, a parent can ask for an IEP whenever. New multidisciplinary evaluations do not have to be given more than once ever 3 years and can only be given more than once in a given year if both the district and the parents agree. I'd ask to meet with the team to ask why they think they need new testing. And EXACTLY what sort of testing they plan on doing...don't sign a blanket agreement. I do not necessarily suspect that something is bad about this request. I just believe you, as the parent, need to be FULLY informed.
You ask about speeding up the process? What do you want speeded up? Your child's old IEP must be implemented as closely as feasible as it stands until such time as a new IEP can be created. Your child cannot be without services while you are all waiting to meet, even if you moved from another state. The only difference if you moved from another state is that they MUST have an IEP meeting, officially, whereas if you moved from inside the state, they can just agree to adopt the old one.
