My child & I need help! | Autism PDD

Welcome to the board green clovers. Sorry to hear of the mess. If all of this is court ordered and the father is NOT following the court order I would deny visitation and file a comtempt of court charge against him. Have you also asked for a guardian edliteum (sorry about the spelling) for your child?

Wish I could be more help,...... may of us go through visitation issues with our special needs kids and it seems the courts just don't want to get involved!  I hope you find something that helps!

This is a long story, so I will attempt to keep it brief!  My son is 6 years old and has autism, MR, speech delay and sensory issues.  Since he was 18 months old I have had him in therapy and he now has a personal aide at home so that I can work.  Logan's father has never recognized or accepted that Logan has these delays and "issues".  Because he refuses to keep life consistent for Logan when Logan is on his visits with his father, I petitioned the court to make it so the personal aide had to go with Logan for his summer visits.  The Judge willingly put that in the order.  Logan's aide has been deemed medically necessary to provide safety and consistency to his life.  There is an actual prescription for the services that has been signed by the Peditirician.  Logan's father has denied access to his home to Logan's permenant aide, and has fired a secondary aide.  He has now petitioned the court to "not allow the aide in his residence as there is no medical necessity for the service."  OK!  Folks, here is my question for all of you and I would like some kind of help if there is anyone out there that can help!  The judge denied my son emergency relief from his father's residence even though his father had ignored the court order ordering him to take Logan to ALL therapy appointments and his special school and numerous other issues.  Children and Youth say that it is not a neglect issue.  IF a child is not receiving court ordered and medically necessary treatment, is that not neglect?  If his schedules and treatment recommendations are not being followed is that not neglect or abuse?  This child has regressed and will not be able to attend his regular kindergarten class starting in August - he will probably be placed in the preschool program again!  At the end of school he was prepared to move forward, now he has moved back.  IS there ANY relief for this child?  Is there any agency or anyone who can help him??????????????Wow!  I am so sorry.  I have no answer for you but wanted to let you know I hear you.  I will ask around.  Also from PA.  Keep us posted and I will let you know what I find out.You should try to find an attorney who specializes in disability advocacy in your area.  I'm sure money is an issue (who ISN'T money an issue for?!), but maybe speaking with one would help steer you in the right direction.  Good luck and God bless.
