Did you sign the paperwork for your child to be subject to corporal punishment as the county requires?  If not, that is additional evidence.  Since no one is talking, you MUST get a lawyer and/or a court involved.  These witnesses will be subpoenaed (sp?) and will HAVE to tell the truth or go to jail.  This is really not something an IEP Team can address.  It's a subject for your school board and the legal system.  It DOESN'T MATTER if your school allows corporal punishment.  A child with a disability HAS to have a manifestation determination meeting to determine if the misbehavior is a manifestation of the disability.  If it is, no punishment is allowed according to IDEA 2004.  Is there any way you can find out from other parents what their children said happened.  Clearly, they were witnesses.  It's also the school's RESPONSIBILTY to keep children safe. If a child comes home with bruises on the bottom, this was no playground accident. They are responsible for finding out what happened.  Please, please, please get a lawyer NOW.  Many lawyers in these situations will take very little for retainer because they know they can get a big settlement from the school later, when a judge slams the school.

Where we live we have a local tv station that exposes all kinds of different events its called 10 on your side and believe me I would have been on the phone to them since it doesnt seem that any progress is being made. I feel so bad for your daughter and you. We entrust these fools to do the right thing by our children and they figure they can get away with it. I would at the very least get an attorney. We contacted Special Ed director and the Assistant Director at thier home. Child was taken to the ER for documentation. We contacted DFCS and involved them. Letters started going out to the school, Board Education, Special Education dept, Our State Senator & Representative( both of which we know personally and know my child).  There was a meeting held on Wednesday with all school persons involved with my child, the principal of school, SP. Ed  Director, Our DFCS caseworker, my husband and myself.
 
 At the Resolution meeting the teacher and parapro stated that the child did not leave their sight.The school does not know anything. They deny that a paddling/spanking took place. they were very tight-lipped( imagine that!). This was the same thing when the Special Education Department inquired. DFCS is at a standstill because no one is talking.
 
I contacted a deputy who investages child abuse and he is currently working on the case.
 
 My child will finish the last 28 days at a new school. This new school is the place where she will start 3rd grade next year.
 
 My child is out of a harmful environment. There will be an iep meeting to include NO SPANKING,Paddling, hitting, harrassing........., ect.......  We just had her annual IEP on Wed before the Friday that she was beaten with a  blunt object.
 
 Where can I find answers to these questions? DO I continue with a due process since the person/persons responsible for abusing my daughter is still at that school?
Is due process a mute because measures have been taken to protect the child?

GET A LAWYER INVOLVED!!!! In what state is spanking still allowed??? I know there are some, but NOWHERE is a child allowed to be punished for behaviors that are a result of his or her disability. THAT IS FEDERAL LAW.  That is also why these villains are staying mute. The system would CREAM them.  Also why you need to get a lawyer involved.  No IEP can protect your child in a situation like this.  If a school ignores Federal law, they will CERTAINLY ignore an IEP.

There are 22 states that allow spanking. Georgia is one of them. Our county allows the parents to sign a form to if the system can use Corporal Punishment or not.   We fully intend on pursuing this matter to the MAX. Thank you.

 

NICK has a program on AUTISM starting so Our Family is going to watch it. I will check posts later.

I just yesterday read about something similar on an ADHD board.  Not only had school personnel hit this woman's son, but also IN FRONT of her.  Not surprisingly, he was very aggressive in school.  That school had the nerve to repeatedly report the woman and her husband to CPS b/c of his behavior.  He's now apparently in foster care.  Schools like these give all public schools a bad name! 

OH MY GOD!!!!!!!!!  How horrible!!!!!!!!!!!!!! Get a lawyer....now!!!!!!!!!!
