First of all, since he is "parentally placed in a private school," the rules have changed. NOW it's possible that the school district of his school's LOCATION will be responsible. Each state is addressing the new private school rules differently, so you have to see what Ohio is doing.
Your son's CURRENT IEP stays in place if there is no new one. BUt if they don't meet within ONE year, they are in violation and you could end up taking them to a Hearing for failure to provide FAPE. In any event, write a letter to them asking them to convene and IEP meeting since your son's is due by (put in the date). If Ohio STILL has the district of parental residence as the district that is supposed to hold the IEP meeting, you have no alternative than to DEAL with your district or move.
Ohio has some pretty dumb rules when it comes to autism. Because of a horrible experience with the public school (some of you may remember they lost my three year old), my son is attending a special center for autistic kids instead of the public school. We take advantage of Ohio's autism scholarship. Even though he does not attend the public school, the school district is still responsible for generating the IEP. Ryan will be five in May, which means he could go to kindergarten. We had such a horrible time with the school district last year at this time, that I really hate working with them at all. The kicker is-- I am a first grade teacher for the district. The elementary principal (who is also my boss and sees me everyday) mentioned in the beginning of March that the team should get together to discuss the options for Ryan. I told him just to let me know-- knowing in my mind that his behavior counselor and I have already written new goals that I want in the IEP. I have heard nothing else. His IEP expires in May, and I refuse to be responsible for getting the district's team together. What happens if they just "forget" all about Ryan? This school district is absolutely uninformed and lacking ANY knowledge to help autistic kids. I can't imagine what kind of goals they think they would write for a kid they haven't seen all year!!!!!
