Hi. I'm actually asking this question for a friend. She is having an independant evaluation of her child and was told that the dr. would only be allowed a half hour to observe in the classroom per district policy. Could this possibly be legal? Any advice would be greatly appreciated. Thanks so much. I believe she did ask for their policy in writing and is waiting to hear back.
Since you are in NY and I assume she is, MEMORIZE the Part 200 and 201. These are the IDEA 2004-based NYS regulations about schooling and discipline for special needs kids:

NO. Also, ask that the District send you the policy in writing. Your evaluator has to have the SAME access to your child as the District's evaluator has had. This is a touchy issue and I recently saw the same question appear in a forum where lawyers discuss these things. Your friend MAY have to seek legal counsel.
