You are totally correct about #2, but this is often a really difficult think since there are so many factors.  It is your right to be an equal partner, but it is also wise to not create enemies.  It can be a balancing act.  #1, You should look at the preschool section of the Part 200, the NYS spec. ed. regs.  http://www.vesid.nysed.gov/specialed/publications/lawsandreg s/part200.htm

My son started in preschool at age 2 years 4 months, but that was back in 1993.  The law has changed somewhat since then, but I believe you should probably be able to get your child into preschool before her actual 3rd birthday.  Here's a link to NYS preschool info:  http://www.vesid.nysed.gov/lsn/ecdc/home.html

Hi. We just had our first - rather disappointing - meeting with our school
district. Any advice on the following issues would be greatly
appreciated...

1) Our daughter turns 3 at the end of July so she will miss the schools
ESY program which ends mid July. The school psychologist who attended
the meeting said that she wasn't entirely sure but thought that our
daughter would have to go without services for the entire month of
August. (I should add that the asst director of special ed who was
supposed to attend the meeting didn't show up and the school
psychologist seemed way out of her element whenever we asked a
"policy" question.) My understanding was that schools cannot limit the
duration of ESY services if you can demonstrate a need.

2) One of our big concerns with our district is that they don't allow
parents to observe any of the programs until after a determination of
placement has been made. I pointed out that this is completely ridiculous
if we're supposed to be "equal members" of the team. Again, she seemed
a little flustered and didn't really have an answer other than "well, that's
our policy".   I'm wondering if this is worth fighting about?
