Birth to 3 is not covered under Federal law. You have to check with your state's birth to 3 law. At age three, I am not really certain. Google IDEA 2004 and look up the preschool section or go to www.wrightslaw.com and search preschool or evaluations to see what they have to say about this. I am thinking they don't HAVE to test. A full re-eval only has to take place every three years even when kids are past their third birthday. HOwever, I'd think that certain types of testing needs to be done at least once a year in order to discover Present Levels of Performance, which is what every IEP is based on. Ask them about your son's Present Level of Performance in OT, PT and Speech and see what they say.I have Ethans IEP meeting on Feb 15th. The ot pt st and se ed teacher (from the district) have all come to the house to "observe" Ethan when he is working with one of his birth to 3 therapists. They told me over and over they did not need to evaluate because we have had so many done the last year. Is this something I should insist on? I figured I could always ask for it at the meeting and refuse to sign the iep until then if necessary. Actually , we are having a eligibility meeting next week. Maybe I should hear what they have to say then and ask for further evaluations at that point if necessary. I can request them at any time, can't I? The sd ot told me to make sure and be ready to fuss because they will offer almost nothing. I've been reading up on the laws. Making my lists. I have learned so much from you and others here.
