The following links are important.  The first is to the New York State regulation of IDEA. This is its most current permutation.  When you pull it up, scroll down to 200.13  This is the special section on autism.  Most of this will only officially apply when your son reaches kindergarten age because, before then, he cannot be classified as anything but a "preschool child with a disability."  In kindergarten, he can be classified under "Autism" if he fits the definition of "Autism, which is on page 11 of this Part 200 document. 

The second is a link to State Ed info on autism that is not a formal part of the law.  Your son now qualifies for services through your school district.  If you haven't already, contact the spec. ed. director, in writing, that you want your child to be fully evaluated for spec. ed. services.  This is not a diagnosis for autism. It is testing to see what his deficits are (academic, physical, social and behavioral).  A medical diagnosis of autism, PDD-NOS or Asperger Syndrome is not NECESSARY to qualify for autism services, but it can't hurt.  However, services are related to the child's deficits, not to his diagnosis. So that, in theory, if an autistic child shows no deficits, he gets no intervention.  Of course, if a child like this showed no deficits at all in the previously mentioned areas, he could not QUALIFY for a medical dx of autism.

Sorry to call you out tzoya, but I have a question I was hoping you could answer.  I noticed you live in NYS and have a wealth of knowledge of NYS special ed law and was wondering if you could point me in the direction of the special laws concerning an autism label in NY. 

My 3y.o. son was recently diagnosed and want to find out as much as I can about the laws and regs in NYS.  Is there a website I can visit?  Can I find the info in the NYSED site?

I appreciate any help you can offer.
